ClariLung Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the ClariLung mobile app, Apple Watch app, Wear OS app, and backend services (together, "ClariLung"), published by Duskfield Studios LLC ("Duskfield," "we," "our," or "us"). By creating an account or using ClariLung, you agree to these Terms. If you do not agree, do not use ClariLung.

2. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use ClariLung. ClariLung is a harm-reduction and behavior-change tool for adults seeking to reduce or quit nicotine or cannabis use. Do not use ClariLung if you are pregnant, nursing, have a serious medical condition, or are under the care of a clinician for substance use without consulting that clinician first.

3. Medical Disclaimer

ClariLung is not a medical device and does not provide medical advice, diagnosis, or treatment. AI Coach responses, health milestones, breathing exercises, and taper suggestions are educational and general in nature. Always consult a qualified healthcare professional before making decisions about nicotine replacement therapy, medication interactions, or any other aspect of your care. If you experience a medical emergency, call your local emergency number.

4. Accounts and Security

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately at support@duskfieldstudios.com if you suspect unauthorized access. We may suspend or terminate accounts used for abuse, fraud, harassment of buddies, or violation of these Terms.

5. Subscriptions and Billing

ClariLung offers a free tier with core quit tools and an optional ClariLung Premium subscription at three price points:

• Weekly — $3.99 per week
• Monthly — $6.99 per month
• Yearly — $49.99 per year

Prices are in US dollars and are subject to change with notice. Subscriptions are billed through Stripe, the App Store, or Google Play depending on how you signed up. Subscriptions renew automatically at the end of each billing period until cancelled. Cancel at any time from your account settings, the App Store, or Google Play — your access continues through the end of the paid period. We do not offer prorated refunds for partial periods except where required by law or platform policy.

6. Acceptable Use

You agree not to:

• Use ClariLung for any unlawful purpose
• Attempt to reverse engineer, decompile, or access the source code of the app or backend
• Interfere with, overload, or disrupt the service or any connected networks
• Harass, threaten, or abuse other users through the buddy or encouragement features
• Automate requests to the AI Coach, scrape content, or share account credentials
• Upload content that is illegal, infringing, or contains malware

7. User Content

You retain ownership of everything you log in ClariLung — puff events, journal entries, chat messages, streak history. You grant Duskfield a limited, non-exclusive license to store, process, and display this content only to operate the service for you. We do not use your content to train third-party AI models, and we do not sell or share it with advertisers.

8. Intellectual Property

ClariLung, the ClariLung name and logo, the Duskfield Studios name and logo, and all related software, content, and designs are owned by Duskfield Studios LLC and are protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right to our trademarks or other intellectual property beyond the limited use required to operate the app.

9. Disclaimers

ClariLung is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure, or that the AI Coach, health milestone, or taper calculations will be accurate for your specific situation. To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Duskfield Studios LLC and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of ClariLung, including any health outcomes. Our total liability for any claim arising from these Terms or ClariLung will not exceed the greater of one hundred US dollars ($100) or the amount you paid us in the twelve months preceding the claim.

11. Termination

You may stop using ClariLung and delete your account at any time from Settings. We may suspend or terminate your access for violation of these Terms, for safety reasons, or if we discontinue the service. Sections 3, 7, 9, 10, 12, and 13 survive termination.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which Duskfield Studios LLC is registered, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts with jurisdiction over that state, and you consent to that jurisdiction and venue.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in-app or by email. Continued use of ClariLung after the effective date of the updated Terms constitutes acceptance.
